Ex-Dallas Running Back Sued Over Alleged Wind Farm Loan Misuse

A Native American investment group called Kituwah LLC has taken former Dallas Cowboys star Emmitt Smith to court. They say he and his business partners mishandled a $2.5 million loan meant for a wind farm in Texas. The suit was filed in Delaware this week.\n\nKituwah claims the money went to a firm named 4 13 Solutions, which used it to pay back an earlier investor linked to Smith’s own company. The group says Smith and his longtime partner David Mosley told them they were working on a government loan that would have triggered repayment. According to the lawsuit, those statements were not true.\n\nThe suit says the loan has grown by about $600,000 in interest and Kituwah wants a jury to decide what damages are owed. They also point out that a man named Darrel Wilson from Wilson Holdings said he got the $2.5 million from Smith’s company but did not know why it was sent. Kituwah’s lawyers co

mpare the situation to a Ponzi scheme. They argue Smith and Mosley knew the wind farm project, called Project Exodus, would not get the needed government backing, yet they told Kituwah the money had been used to buy the project and that delays were just temporary.\n\nKituwah says it handed over the funds on September 1, 2023, expecting repayment within a few months. The lawsuit notes that 4 13 Solutions promised the wind farm would be running by December 2024, but Kituwah saw no sign of the project even a month before that date. They also say Smith and his partners claimed the farm would be worth almost $400 million and could bring in roughly $14 million in net income during its first year.
